1. Scope of Services
The Modern Edge provides professional landscape design, 3D visualization, and consultation services for residential and equestrian properties.
Design Only: Unless otherwise specified in a signed project contract, our primary deliverables consist of design plans and renderings.
Equestrian Specialization: Our services regarding equestrian properties focus strictly on the surrounding landscaping, greenery, and hardscapes. We do not provide engineering or construction services for equestrian riding facilities, barns, or arenas themselves.
2. Intellectual Property
All designs, 3D renderings, site plans, and website content created by The Modern Edge are the intellectual property of the company.
Clients are granted a limited license to use the final design deliverables for the specific property intended.
Redistribution, resale, or public use of our renderings for commercial purposes without written consent is prohibited.
3. Client Responsibilities
To ensure accuracy in our visualizations, clients are responsible for providing:
Accurate property boundaries and site surveys.
Information regarding underground utilities or easements.
Timely feedback on design iterations.
4. Payments and Refunds
Consultation Fees: Fees for initial consultations are due at the time of service.
Project Deposits: Design projects require a deposit as outlined in your specific project proposal before work commences.
Refunds: Due to the custom nature of design work, fees paid for completed design phases are generally non-refundable.
5. Revisions and Modifications
Our design packages typically include a set number of revisions (e.g., adjustments to materials, steps, or plant selections). Any modifications requested beyond the scope defined in the project proposal may incur additional design fees.
6. Limitation of Liability
The Modern Edge provides visualizations as artistic representations of design concepts. While we strive for hyper-realism, final construction results may vary based on site conditions, material availability, and the practices of third-party contractors. We are not liable for any construction errors made by independent contractors.
7. Governing Law
These Terms are governed by the laws of the State of Kentucky and the State of Illinois, corresponding to our service locations in Lexington and the greater Chicagoland area.
8. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of our website or services following any changes constitutes your acceptance of the new Terms.
